Terms of use & End-User License Agreement
Effective date: July 27, 2026. These terms govern your use of the KindCaddy website at kindcaddy.com and the KindCaddy application and services at app.kindcaddy.com (together, the "Services"). By accessing or using the Services, you agree to these terms. If you use the Services on behalf of an organization, you agree on its behalf.
The KindCaddy application and services
Subject to these terms, KindCaddy grants you a limited, non-exclusive, non-transferable, revocable right to access and use the KindCaddy application for your internal business purposes. The Services let you connect third-party tools and use AI-assisted workflows to work with your own business data.
Accounts and eligibility
To use the application you may need to sign in and create a workspace. You are responsible for maintaining the security of your sign-in method and for all activity under your account. You must be old enough to form a binding contract and must provide accurate information. Notify us promptly of any unauthorized use of your account.
Acceptable use
You may use the Services for lawful purposes only. You agree not to misuse the Services, attempt unauthorized access, disrupt or interfere with their operation, reverse engineer the hosted systems except as permitted by applicable law or the software's open-source license, or use the Services to violate the rights of others or any applicable law. You are responsible for the data you connect and the instructions you give the application.
Third-party integrations (QuickBooks Online, Google, and others)
The application lets you connect third-party services such as Intuit QuickBooks Online and Google. When you connect a service, you authorize KindCaddy to access and use data from that service on your behalf to provide the features you request. Your use of each third-party service remains subject to that provider's own terms (for example, Intuit's and Google's), and their handling of your data is governed by their policies.
We access third-party data only as needed to deliver the features you invoke, store any authorization tokens in encrypted form, and never sell your connected data or use it to train AI models. You can disconnect any integration at any time from the Integrations page in the application, which removes the stored authorization. See our Privacy Policy for details.
AI-generated content
The application uses artificial intelligence to generate responses and to take actions you request. AI output can be inaccurate or incomplete and is provided for your convenience only. It is not professional, financial, accounting, tax, or legal advice. You are responsible for reviewing and verifying AI output — including any records created or modified in a connected service such as QuickBooks — before relying on it.
Your model API key (BYOK)
The application may let you supply your own AI model provider API key ("your key") on the Configuration page. If you do, you are responsible for your key, for any usage and charges billed by that provider, and for complying with that provider's terms. By supplying your key, you authorize KindCaddy to use it to transmit your requests to the provider you selected in order to deliver the features you invoke.
Your key is stored only in an encrypted, browser-session cookie and is never stored in our database; it is cleared when your browser session ends or when you remove it (see the Privacy Policy). KindCaddy is not responsible for the availability, output, pricing, or data practices of third-party AI providers. If you do not supply your own key, requests use KindCaddy's default AI provider.
Your data and content
As between you and KindCaddy, you retain all rights to the data and content you provide or connect ("Your Data"). You grant KindCaddy a limited license to process Your Data solely to operate and provide the Services to you, including sending the data needed to fulfill a request to the AI model provider configured for your session (your own provider if you use your own key, otherwise KindCaddy's default provider). We do not use Your Data to train AI models. Our handling of Your Data is described in the Privacy Policy.
Open-source software
KindCaddy's software is developed in the open and made available as open source under the license stated in our public code repository. That license governs your rights to the source code itself and is provided on an "as is" basis. These terms govern your use of the hosted Services operated by KindCaddy; where the two overlap, the open-source license controls the source code and these terms control the hosted Services.
Intellectual property
Except for Your Data, and except as provided by the open-source license above, the Services and their content are owned by KindCaddy and protected by intellectual property laws. KindCaddy's names and logos may not be used without permission.
Disclaimers and limitation of liability
The Services are provided on an "as is" and "as available" basis. KindCaddy does not guarantee uninterrupted availability, error-free operation, or that AI output or connected-service actions will be accurate. To the maximum extent permitted by law, KindCaddy is not liable for indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Services.
Termination
You may stop using the Services and disconnect any integrations at any time. We may suspend or terminate access if you violate these terms or to protect the Services or other users. On termination, the rights granted to you end; sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will survive.
Changes to these terms
We may update these terms from time to time. Updates will be posted on this page with a revised effective date; material changes may be highlighted more prominently. Continued use of the Services after an update means you accept the revised terms.
